Sparki.Academy — Terms of Use

By purchasing, downloading, or using any digital product or service from Sparki.Academy, you agree to the following terms.

1. Digital Products Are Delivered As-Is

All digital products — including but not limited to SOPs, templates, checklists, prompt libraries, and AI workflow tools — are delivered as-is at the time of purchase. Sparki.Academy makes no guarantee that any tool will produce specific results for your company, your projects, or your market conditions. These products are frameworks built for commercial electrical estimating and project management. They are starting points, not finished deliverables. The buyer is responsible for reviewing, customizing, and verifying all outputs before use on any project or bid.

2. No Refunds on Digital Downloads

All sales of digital products are final. Because digital products are delivered immediately upon purchase and cannot be returned, no refunds will be issued. If you experience a technical issue with a download (corrupted file, missing content, broken link), contact support@sparki.academy within 7 days of purchase and we will resolve it.

3. Consulting Services

Consulting engagements (spec assessments, schedule reviews, AI workflow setup, and similar services) are scoped and priced per engagement. Payment terms, deliverables, and timelines are defined in the project proposal or contract provided before work begins. Consulting deliverables are covered by the terms of the applicable consulting agreement, not these Terms of Use.

4. AI Tools Disclaimer

Many Sparki.Academy products involve the use of artificial intelligence, including large language models. AI-generated outputs are not a substitute for professional judgment. The buyer is solely responsible for reviewing, verifying, and validating any AI-generated content before relying on it for estimating, project management, contract interpretation, or any other business decision. Sparki.Academy is not liable for errors, omissions, or misinterpretations in AI-generated outputs, whether produced by Sparki.Academy tools or by the buyer using prompts or workflows purchased from Sparki.Academy.

5. Limitation of Liability

Sparki.Academy's total liability for any claim arising from a digital product purchase is limited to the purchase price of that product. Sparki.Academy is not liable for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost bids, project cost overruns, or contract disputes arising from the use of any product or service.

6. Intellectual Property

Digital products purchased from Sparki.Academy are licensed for use by the purchasing individual or company. Products may not be resold, redistributed, shared publicly, or repackaged for commercial distribution without written permission from Sparki.Academy. Buyers may modify purchased tools for internal use within their own company.

7. Governing Law

These terms are governed by the laws of the State of Delaware. Any disputes arising from these terms or from the purchase or use of Sparki.Academy products or services will be resolved under Delaware law.

8. Changes to These Terms

Sparki.Academy may update these terms at any time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the site or products after an update constitutes acceptance of the revised terms.
